Terms and Conditions of Online Courses Organized As Part of Asian Cinema Education at the piecsmakow.pl/education Platform

§ 1

Definitions

  1. Course – a cycle of thematically linked online classes (thereafter referred to as "Webinars") offered by the Organizer and Co-organizers at the Platform – piecsmakow.pl/education.

  2. Organizer – Arteria Art Foundation located in Warsaw at ul. Świętokrzyska 30/68A, 00-116, Warszawa, entered into the register of associations, other social and professional organizations, foundations and independent public health care units, and the business register of the Regional Court for Warsaw, XII Commercial Division of the Polish Company Register under the KRS number: 0000213829, NIP number: 521-329-94-74, Regon number: 015779463.

  3. Co-organizers – Stichting Tamago located in Rotterdam at Rochussenstraat 5 A, 3015 EA Rotterdam, The Netherlands, registered under the number 24384162; Elokuvien Aasia ry / Asian Cinema Association of Finland located in Helsinki at Alppikatu 3 B 59, FI-00530 Helsinki, Finland, Businness ID / Y-tunnus: 2561838-4; Associazione Centro Espressioni Cinematografiche located in Udine at Via Villalta 24, 33100 Udine, Italy, registered under the number 512/CF80008140305.

  4. Participant – a natural person who has accepted these Rules and Regulations, has expressed the wish to participate, has filled in the required form and has been accepted by the Organizer as a Course Participant.

  5. Expert – a natural person conducting the Webinar.

  6. GDPR – the General Data Protection Regulation (EU) 2016/679 adopted on 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Data Protection Directive) (OJEU L, 119, 2016, p. 1, as amended)

§ 2

General Information

  1. These Rules and Regulations determine the organization and execution of the Courses and the rights and responsibilities of the Organizer, Co-organizers, and Participants.

  2. The Organizer and the Co-organizers offer the possibility to participate in Courses on subjects specified at the Platform.

§ 3

Conditions of Participation

  1. The number of Participants is limited.

  2. To apply to participate, it is necessary to accept these Rules and Regulations, and express the wish to participate by filling in the required form available at the Platform.

  3. Participating in the Course is free of charge.

  4. The Organizer reserves the right to admit only the chosen candidates as Participants, after consulting with the chosen Experts.

  5. The chosen Experts will be provided with the filled-in forms to help them choose the Participants alongside the Organizer and Co-organizers.

  6. The Organizer will notify the Participant of being admitted to the Course within 7 days after the end of the recruitment for the given Course – the dates are available at the Platform.

  7. A separate recruitment process will be held for each Course.

§ 4

Scope of Services

  1. All Courses are conducted in English only.

  2. The Courses are published on the Platform.

  3. The Webinars are conducted by the Experts.

  4. The Webinars will be available throughout the whole duration of the Course published at the Platform.

  5. The Participant can join a private internet group which will allow them to communicate with other Participants, the Experts, and the Organizer.

    1. The group will be available on the www.facebook.com platform.

    2. To join the group, the Participant needs to have an account on the above-mentioned platform mentioned above.

    3. Communication with the Organizer and chosen Experts will also be possible via the email address given in the form.

  6. The Organizer and Co-Organizers do not provide access to the literature and films discussed during the Courses.

  7. The Experts will check the assignments written by the Participants and will comment on each of them individually.

  8. The Participant who will watch all the Webinars that are a part of the Course they are participating in, and will successfully complete the assignment will receive from the Organizer, after the Organizer consults with the Expert assessing the Participant's assignment, a certificate of Course completion. A negative assessment of the Expert can lead to not issuing the certificate by the Organizer.

  9. A person who is not a Participant can watch all the published Webinars on the Platform, free of charge.

§  5

Participant's Responsibilities

  1. The Participant needs be fluent in spoken and written English.

  2. The Participant needs to have access to the Internet and appropriate equipment (a computer, a tablet, or another device) that will allow them to participate in the Course.

  3. The Participant needs to watch all the Webinars that are part of the Course they are participating in to receive a certificate of Course completion.

  4. Sending the assignment, written by the Participant and fulfilling all formal requirements, to an Expert is required to complete the Course.

  5. In case of insulting or violating the rights of a third party (especially other Participants' or Experts'), violating these Rules and Regulations or moral turpitude, the Organizer reserves the right to remove the person from the group described in § 4 section 5 or from the Course altogether.

§ 6

Copyrights

  1. The proprietary copyrights for the published Webinars belong to the Organizer and the Co-organizers.

  2. By sending the assignment to an Expert, the Participant states that they have full copyrights for the assignment and that the assignment does violate the rights of any third parties.

  3. By sending the assignment to an Expert, the Participant gives the Organizer a free, non-exclusive license for the assignment for an indefinite period of time, without territorial restrictions, on the following fields of exploitation:

    1. in terms of recording and reproduction through the production of copies by any means, including printing, magnetic storage, or digital technology;

    2. in terms of the trade of the original or copies of the recorded work – marketing, hiring, or lending the original or the copies;

    3. in terms of the dissemination of the work through a public display, a screening, or by publicly sharing the work in a manner allowing any person to access it at a time and place of their choosing.

§ 7

Personal Data

  1. The controller of personal data is the Organizer.

  2. Consenting to the processing of personal data is voluntary, but it is necessary to participate in the Course. If the Participant does not submit their personal data, their application will not be considered.

  3. The personal data will be processed for the following purposes:

    1. for the performance of a contract or in order to take steps prior to entering into a contract, in particular choosing the Course Participants by the Organizer, pursuant to Article 6 (1) (b) GDPR;

    2. for compliance with a legal obligation to which the controller is subject, in particular for complaint procedure,  pursuant to Article 6 (1) (c) GDPR;

    3. for the potential assertion or verification of claims, or defense against any claims and other legitimate interests pursued by the controller,  pursuant to Article 6 (1) (f) GDPR.

  4. Personal data will be provided to external entities providing services for the Organizer and Co-organizers, in particular to the Experts;

  5. Personal data will be stored till the day when the claims for participation in the Course expire, with a possibility of an extension if data processing is necessary for the pursuit of claims or defense against any claims and other legitimate interests pursued by the controller.

  6. A person whose personal data is being processed has the right to:

    1. demand from the controller the access to their personal data;

    2. demand from the controller the rectification of their inaccurate personal data;

    3. demand from the controller the removal of their personal data;

    4. restrict the processing of their personal data;

    5. object to the processing of their personal data;

    6. transfer their personal data;

    7. withdraw the consent for processing their personal data at any given time, without affecting the legality of the processing of the data based on the consent prior to the withdrawal;

    8. complain to the President of the Office of Personal Data Protection.

  7. Decisions concerning the processing of personal data will not be automated.

  8. To execute your rights, you can contact the Organizer in writing at their office address or send and email to education@piecsmakow.pl.

§  8

Complaints

  1. Any complaints should be presented to the Organizer in writing or via email at education@piecsmakow.pl no later than seven days after the end of the Course.

  2. The Organizer will respond within 14 days from the date of receiving the complaint in writing or via email.

§ 9

Final Provisions

  1. The current information on the Courses is published at the Platform.
