Terms and Conditions for the purchase of passes and tickets for events through the website www.piecsmakow.pl

§ 1
Definitions

1. Website – the website in the domain www.piecsmakow.pl, the rights to which belong to the Organizer;
2. Organizer – Fundacja Sztuki Arteria with its registered office in Warsaw at ul. Świętokrzyska 30 lok. 68A, 00-116 Warsaw, entered in the register of associations, other social and professional organisations, foundations and independent public health care institutions and in the register of entrepreneurs kept by the District Court for the Capital City of Warsaw, 12th Commercial Division of the National Court Register, under KRS number 0000213829, NIP (tax ID): 521-329-94-74, REGON: 015779463;
3. Purchaser – a natural person, a legal person or an organisational unit without legal personality but with legal capacity, which concludes with the Organizer an agreement for the purchase of a Pass and/or Ticket; a Purchaser who is a natural person must have full capacity to perform legal acts;
4. Consumer – a Purchaser who is a natural person and concludes with the Organizer an agreement not directly related to their business or professional activity;
5. Participant – a natural person who takes part in an Event on the basis of a Pass and/or Ticket; the Participant may be the Purchaser themselves;
6. Event – a film festival, concert or other event organised by the Organizer (including screenings and events held on site or online) in which one can take part as a result of purchasing a Pass and/or Ticket;
7. Passes – selected documents or digital entitlements confirming the conclusion of an agreement with the Organizer and entitling the holder to take part in an Event, designated by the Organizer for a given Event, i.e. entitling the holder to attend on-site and/or online screenings at film festivals and/or sold to entities from the media and film industry (Accreditations);
8. Tickets – selected documents or digital entitlements confirming the conclusion of an agreement with the Organizer and entitling the holder to take part in an Event, designated by the Organizer for a given Event, i.e. entitling the holder to attend multiple or single film screenings (on site or online), special screenings and concerts;
9. VOD Service Terms and Conditions – the terms and conditions of the “Five Flavours at Home” service, setting out the rules of access to online screenings and films, available on the Website at https://www.piecsmakow.pl/artykul.do?id=554;
10. Terms and Conditions – these terms and conditions.

§ 2
General provisions

1. The Terms and Conditions set out the rules for purchasing Passes and/or Tickets through the Website.
2. Purchasing Passes and/or Tickets through the Website requires the Purchaser to create an account on the Website in accordance with the online services terms and conditions of the website www.piecsmakow.pl.
3. Where an agreement for the purchase of Passes and/or Tickets through the Website is concluded with a Consumer, or with a natural person concluding an agreement directly related to their business activity where the content of that agreement shows that it is not of a professional nature for that person (a so-called entrepreneur with consumer rights), the agreement is a distance agreement within the meaning of the Polish Act of 30 May 2014 on consumer rights.
4. Before concluding an agreement for the purchase of Passes and/or Tickets, the Purchaser is obliged to read the Terms and Conditions. Conclusion of the agreement requires prior acceptance of the provisions of the Terms and Conditions.
5. The Purchaser is obliged to comply with the provisions of the Terms and Conditions.
6. The Terms and Conditions are made available to Purchasers free of charge through the Website in a form that allows them to be downloaded, saved and printed.

§ 3
Rules for purchasing Passes and/or Tickets

1. The Organizer publishes on the Website information about current Events for which Passes and/or Tickets are on sale.
2. The Organizer publishes on the Website information about:
1. the types of Passes and/or Tickets offered, in particular indicating whether they are issued to a named person or to the bearer,
2. the rules for issuing Passes and/or Tickets,
3. the rules for using Passes and/or Tickets, in particular indicating whether a Pass and/or Ticket on its own entitles the holder to take part in an Event, or whether an additional reservation is required for the Event or specific parts of it,
4. the gross prices of Passes and Tickets and the promotions applied by the Organizer,
5. the sales period for Passes and Tickets, indicating the days and/or hours during which orders for Passes and/or Tickets may be placed,
6. the accepted methods of payment for Passes and Tickets,
7. the rules for collecting Passes and/or Tickets,
8. the rules for taking part in Events and the related obligations of the Participant.
3. The publication of the information referred to in section 2 above constitutes an invitation for the Purchaser to make an offer (place an order).
4. Placing an order requires, in particular, choosing the type of Pass and/or Ticket, the quantity, the method of payment and the method of collection, to the extent that the Organizer allows a choice. The Organizer stipulates that only one Pass may be purchased per person; however, a Purchaser may order a Pass on behalf of a third party (the Participant).
5. Passes and/or Tickets that include access to online screenings or films are provided within the “Five Flavours at Home” service. The conditions of using this access, including the requirement to hold a verified Polish phone number, territorial restrictions and technical requirements, are set out in the VOD Service Terms and Conditions, which the Purchaser should read before placing an order.
6. A Purchaser placing an order on behalf of a Participant declares that they are authorised to provide the Participant’s data (including their photograph, if required) and undertakes to provide the Participant with the content of the Terms and Conditions and the rules for taking part in the Event.
7. An agreement for the purchase of Passes and/or Tickets is concluded when the Organizer accepts the order placed by the Purchaser, which takes place by sending a message to the Purchaser’s e-mail address.
8. In the event of reasonable doubt as to the correctness of the data provided in the order (this does not, however, apply to the choice of the type of Passes and/or Tickets, their quantity, the choice of screenings, etc.) or of the Purchaser’s or Participant’s data (including a photograph), the Organizer will attempt to contact the Purchaser in order to correct them. If the Purchaser cannot be contacted or the errors cannot be corrected, the Organizer may cancel the order, informing the Purchaser where possible. If the Purchaser has paid the price, the Organizer will refund the prepayment within 14 days of the date of cancellation of the order.
9. The sale of Passes and/or Tickets is limited by the number of available Passes and/or Tickets. The Organizer makes every effort to keep the offer of Passes and Tickets up to date. If the Organizer accepts an order placed by the Purchaser for Passes and/or Tickets that are currently unavailable, the agreement expires, of which the Purchaser will be informed by e-mail. If the Purchaser has paid the price, the Organizer will refund the prepayment within 14 days of the date of notification of the expiry of the agreement.
10. If the Organizer cancels an Event (and, in the case of a Pass, the entire Event to which the Pass relates), the Purchaser is entitled to a refund of the price paid for the Pass and/or Ticket within 14 days of the date of notification of the cancellation. If the date or venue of an Event changes, the Organizer informs the Purchaser by e-mail; the Purchaser may then, within the period indicated in that notification, give up the Pass and/or Ticket and obtain a refund of the price. The cancellation or change of a single screening or another part of an Event covered by a Pass does not constitute cancellation of the Event; where possible, the Organizer enables the Participant to attend another screening. Refunds are made using the same means of payment as used by the Purchaser, unless the Purchaser has expressly agreed to another method.
11. Unless the Organizer decides otherwise, duplicates of Passes and Tickets will not be issued.

§ 4
Payments

1. Each order placed by the Purchaser is subject to the price stated for the ordered Passes and/or Tickets at the time the order is placed, which is a gross price. The Organizer informs Purchasers of any other charges related to the purchased Passes and/or Tickets.
2. The Purchaser is obliged to pay for the Passes and/or Tickets within 48 hours of the Organizer’s acceptance of the order, unless the Organizer decides otherwise in relation to a specific Event.
3. Payments for Passes and/or Tickets can be made only electronically through the Przelewy24 service.
4. If payment is not made in full within the period referred to in section 2 above, the Organizer may cancel the Purchaser’s order, of which the Purchaser will be informed. If the Purchaser has paid part of the price, the Organizer refunds the entire amount paid.
5. The price is deemed paid at the moment the account of the payment service provider accepting payments on behalf of the Organizer is credited.

§ 5
Collection of Passes and Tickets

1. In the case of on-site Events, unless the Organizer decides otherwise, Passes and/or Tickets may be collected only by the Participant (in person) at the place specified by the Organizer in the description of the given Event published on the Website.
2. Unless the Organizer decides otherwise, in-person collection of a Pass and/or on-site Tickets is conditional on presenting an identity document by the Purchaser or, if the Purchaser has purchased the Pass and/or Tickets for a Participant, by the Participant on whose behalf the Purchaser made the purchase.
3. Access to online screenings or films is granted in digital form and linked to the Purchaser’s or Participant’s account on the Website, under the rules set out in the VOD Service Terms and Conditions.
4. If the Organizer provides a choice between different methods of delivering Passes and Tickets, delivery takes place in the manner chosen by the Purchaser.

§ 6
Right of withdrawal

1. The right to withdraw from a distance agreement referred to in the Polish Act of 30 May 2014 on consumer rights does not apply to Consumers or to the natural persons referred to in § 2 section 3 of the Terms and Conditions in the case of concluding an agreement with the Organizer for the purchase of a Pass and/or Ticket for Events taking place on a specific date or during a specific period, in accordance with Article 38(1)(12) of that Act (provision of services related to entertainment, sports or cultural events on a specific date or during a specific period of service provision).
2. The rules for withdrawal from an agreement concerning access to online films within the “Five Flavours at Home” service are set out in the VOD Service Terms and Conditions.

§ 7
Complaints

1. The Purchaser may submit any complaints concerning the agreement for the purchase of Passes and/or Tickets in writing to the Organizer’s address or electronically to the address given in § 9 section 1 of the Terms and Conditions.
2. A complaint should include the Purchaser’s first name, surname and e-mail address, as well as a brief description of the objections raised.
3. Complaints will be examined within 14 days of their receipt by the Organizer. Failure to respond within this period means that the complaint has been accepted.
4. The Purchaser will be notified of the Organizer’s decision electronically, to the e-mail address given in the complaint, or in writing.
5. A Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular by applying to the provincial inspector of the Trade Inspection (Inspekcja Handlowa) for the initiation of proceedings for the out-of-court resolution of consumer disputes, or to the permanent arbitration court operating at the provincial inspector of the Trade Inspection, and may also obtain free assistance from the district (municipal) consumer ombudsman. § 8
Personal data protection

1. The controller of the personal data of Purchasers and Participants is the Organizer.
2. The rules for processing personal data, including the purposes and legal bases of processing, data recipients, retention periods and the rights of Purchasers and Participants, as well as the rules for the use of cookies, are set out in the Privacy and Cookies Policy available on the Website at: https://www.piecsmakow.pl/artykul.do?id=687.

§ 9
Final provisions

1. The Purchaser should send any questions, opinions and requests concerning the agreement for the purchase of Passes and/or Tickets, as well as any statements submitted to the Organizer electronically, to the following e-mail address: info@piecsmakow.pl
2. The agreement for the purchase of a Pass and/or Ticket concluded between the Organizer and the Purchaser is governed by the version of the Terms and Conditions in force on the date of its conclusion.
3. This version of the Terms and Conditions enters into force on 3 September 2026.
